These Website Terms of Use (“Terms of Use”) govern your access to and use of websites operated by Johnny Bravo d/b/a “DAx“ (“DAx,” “we,” “us,” or “our”), including any pages where you submit inquiries or questionnaire responses (the “Site”). By using the Site, you agree to these Terms of Use and our Privacy Policy.
If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization and “you” means both you and that organization.
These Terms of Use govern website use only. If you engage DAx for paid services, your engagement is governed by the separate Consulting Terms and your Engagement Letter/Order Form.
1) Content & No Legal Advice
All Site content is for informational and educational purposes only. DAx does not provide legal advice on the Site or through downloadable materials. DAx is not a consumer reporting agency and does not furnish “consumer reports” or make eligibility determinations.
2) Acceptable Use (please don’t do this)
You agree not to:
- upload or include consumer personal information (e.g., SSNs, DOBs, credit/criminal reports) in any Site form;
- access or use the Site in violation of law;
- copy, scrape, crawl, index, or harvest the Site or its content by automated means without our prior written consent;
- probe, scan, or test the security or vulnerability of the Site or attempt to bypass any access controls;
- interfere with Site operation (e.g., denial-of-service, malware); or
- misrepresent your identity or affiliation.
If consumer personal information is inadvertently submitted, we may delete or return it and may charge reasonable handling time associated with secure disposal.
3) Intellectual Property; Limited License
The Site and its content (texts, graphics, logos, and downloadable materials) are owned by DAx or its licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for your organization’s internal purposes.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit Site content without our express written consent, except for limited internal use of any templates or checklists we expressly make available for download.
Feedback. If you provide suggestions or feedback, you grant DAx a perpetual, worldwide, irrevocable, royalty-free license to use it without obligation (excluding your Confidential Information shared under a separate NDA or Engagement Letter).
4) Links & Third Parties
The Site may link to third-party sites or services. We don’t control and aren’t responsible for their content or practices. Review their terms and privacy policies.
5) Disclaimers
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We don’t promise the Site will be uninterrupted, secure, or error-free.
6) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS/REVENUE, ARISING FROM OR RELATING TO YOUR USE OF THE SITE.
IN ANY EVENT, DAX’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED $100.
These limits do not reduce liability that cannot be limited under applicable law.

Your use of the Site is subject to our Privacy Policy, which explains what we collect and how we use it.
8) Termination
We may suspend or terminate access to the Site at any time, with or without notice, if we believe you’ve violated these Terms of Use or to protect the Site or other users.
9) Governing Law; Venue
These Terms of Use are governed by the laws of California. The parties consent to the exclusive jurisdiction and venue of (a) the Superior Court of California, County of Riverside, or (b) the U.S. District Court for the Central District of California, Eastern Division (Riverside), for any action related to the Site.
10) Changes
We may update these Terms of Use from time to time. The “Last updated” date above reflects the effective date. Continued use of the Site after changes means you accept the updated terms.
